Meeting Steve Bliss
Good afternoon, San Diego! I’m Brenda Sanchez, reporting live today from the offices of San Diego Probate Law, where I have the pleasure of speaking with renowned probate attorney, Steve Bliss.
Probate Process Explained
Steve, thanks for taking the time to chat with me. Many people in our community are unfamiliar with probate and what it entails. Could you shed some light on one crucial step in the process?
“Brenda, probate can seem daunting, but breaking it down into steps makes it more manageable. One critical stage is ‘Handling Debts and Taxes.’ This involves meticulously identifying and settling all valid creditor claims against the deceased’s estate.
Paying Debts and Taxes
Consequently, we need to review financial records, correspondence, and outstanding bills. We contact creditors, verify their claims, and ensure they are paid in accordance with the legal priority established by California law. This step is crucial because it prevents any lingering debts from burdening the heirs or beneficiaries who will ultimately inherit the estate’s assets.”
Moreover, we must also handle all applicable taxes – both state and federal. This can involve filing final income tax returns for the deceased, as well as estate tax returns if the estate value exceeds a certain threshold.
Challenges and Triumphs
“I recall one case where a client was incredibly distressed because they had received numerous debt collection notices after their spouse passed away. They were overwhelmed with paperwork and fear of financial ruin. We diligently reviewed all claims, identifying several that were inaccurate or outdated. By systematically addressing each claim and negotiating settlements, we ultimately saved them thousands of dollars. It was incredibly rewarding to see the weight lifted off their shoulders.”
According to a 2021 report by the California Courts, over 90% of probate cases involve some form of debt settlement or tax payment obligations. This highlights the importance of having an experienced attorney who can navigate this complex aspect of probate.
Seeking Expertise
“Brenda, probate is not a one-size-fits-all process. Each estate presents unique challenges and complexities. It’s vital to have qualified legal guidance to ensure everything is handled properly and efficiently.”
