“Trusts are incredibly valuable tools for a variety of reasons,” explains Mr. Bliss. “They allow individuals to control how their assets are distributed after they pass away, minimize estate taxes, and even protect assets from creditors.
Choosing the Right Type of Trust
With so many different types of trusts available, how do people know which one is right for them?”
“That’s a great question,” says Mr. Bliss. “The best type of trust depends on individual circumstances and goals. For example, a revocable living trust is a popular choice because it allows the grantor to maintain control over their assets during their lifetime while avoiding probate. Conversely, an irrevocable trust offers more robust asset protection but sacrifices flexibility.”
Understanding Irrevocable Trusts
Can you elaborate on irrevocable trusts and their benefits?
“Irrevocable trusts are designed to be permanent,” explains Mr. Bliss. “Once assets are transferred into an irrevocable trust, the grantor generally relinquishes control over them. Consequently, these assets are typically shielded from creditors and lawsuits. Moreover, because the assets no longer belong to the grantor’s estate, they may be exempt from estate taxes. This can be especially beneficial for individuals with significant wealth who want to minimize the tax burden on their heirs.”
Mr. Bliss recalls a situation where an irrevocable trust proved invaluable. “I had a client whose business was facing a potential lawsuit,” he shares. “By establishing an irrevocable trust and transferring some of his assets into it, we were able to protect those assets from being seized in the event of a judgment against him.”
Navigating Complexities
Are there any common challenges or misconceptions associated with irrevocable trusts?
“One common misconception is that irrevocable trusts are inflexible,” notes Mr. Bliss. “While it’s true that they cannot be easily modified or revoked, certain provisions can be built in to address potential future needs. For instance, a trust could include language allowing for distributions under specific circumstances, such as a beneficiary’s illness or disability.”
