Steve, many people might not be familiar with the term “probate” or why it’s necessary. Can you explain what probate is and why filing a petition is an important step in estate planning?
“Probate is essentially the legal process of administering a deceased person’s estate,” Steve explains. “It involves identifying and valuing assets, paying debts and taxes, and ultimately distributing the remaining property to heirs or beneficiaries according to the will or state law.”
He goes on to say, “Filing a petition for probate is crucial because it officially kicks off this process. It’s essentially a request to the court to appoint an executor or administrator who will be responsible for managing the estate.” Ordinarily, this step involves submitting necessary documents, such as the deceased person’s will (if one exists), and formally notifying interested parties.
“Think of it like setting the stage for a carefully orchestrated performance,” Steve adds. “Without filing the petition, there’s no director to guide the process, which could lead to confusion, delays, and potential disputes among heirs.”

Steve, have you ever encountered any specific challenges or hurdles during the petitioning phase?
He recounts a situation where siblings were estranged for years. When their mother passed away, they struggled to agree on who should be appointed as executor. “It was emotionally charged,” Steve recalls. “We had to carefully mediate and find common ground while respecting everyone’s feelings.”
“Ultimately,” he continues, “we were able to reach a compromise, demonstrating that even in complex family dynamics, the probate process can be navigated with sensitivity and fairness.”
