Additionally, the terms of a revocable living trust are generally private, unlike wills which become public record during probate.

Steve Bliss: Occasionally, people underestimate the importance of updating their trust as life changes occur. A marriage, divorce, birth of a child – these events necessitate revisiting your trust documents to ensure they accurately reflect your wishes.

I recall one instance where a client had created a revocable living trust several years prior but hadn’t updated it after getting remarried. When she passed away, the trust didn’t account for her new spouse, leading to some unintended consequences and family conflict.

Fortunately, we were able to resolve the situation amicably, but it highlighted the need for ongoing review and maintenance.
